Purpose. These general terms of sale and participation (“Terms”) govern bookings, sales and participation in events, touring rallies, roadbooks, driving days, GPX activities, digital services and related services offered by FUN4ROAD SRL. They apply to www.fun4road.be, Fun4Road subdomains and every booking confirmed by Fun4Road.

3. Acceptance and contractual documents

The Client accepts these Terms when submitting a booking request, confirming participation, making a payment, signing a Fun4Road document or participating in an event. The contractual documents include, as applicable, these Terms, the event’s special conditions, the offer, booking form, invoice, safety instructions, driving rules, waivers or documents imposed by a circuit, venue, supplier or authority.

In the event of conflict, the special conditions accepted before booking prevail for the relevant event. In the event of divergence between language versions, the French version prevails, unless mandatory law provides otherwise.

4. Formation of the contract

A booking request does not constitute final acceptance. The contract is formed only when Fun4Road confirms the booking in writing, by email, via its interface or on another durable medium. Fun4Road may refuse a booking, including where the file is incomplete, payment is missing, the booking is incompatible with the profile of the event, safety cannot be ensured, capacity has been reached or there is a serious history of non-compliance with rules.

5. Prices, taxes and payment

The applicable prices are those communicated by Fun4Road at the time of the request or offer, subject to obvious error or amendment before acceptance of the booking. Unless stated otherwise, prices are expressed in euros and include VAT where applicable.

Payment must be made according to the communicated terms and deadlines. Unless otherwise agreed in writing, the balance must be received before the event and no later than the date stated in the offer, invoice or confirmation communication. In the event of late payment, Fun4Road may suspend or cancel the booking without compensation, after a reasonable reminder where appropriate.

6. Right of withdrawal and dated bookings

Where the service relates to a leisure activity, event or service scheduled for a specific date or period, the Client acknowledges that the statutory right of withdrawal applicable to certain distance contracts does not apply within the limits of Belgian and European law. The cancellation rules below then apply contractually, without prejudice to mandatory consumer rights.

7. Cancellation by the Client

Any cancellation must be notified in writing to info@fun4road.be. The relevant date is the date of receipt by Fun4Road. Unless more specific special conditions were communicated before booking, refunds are calculated as follows:

A technical problem with the vehicle, illness, personal unavailability, delay, route error or missing required document does not entitle the Client to more favourable treatment, unless Fun4Road grants a written commercial gesture or mandatory law provides otherwise.

8. Replacement of a participant or vehicle

The Client may request replacement of a participant or vehicle. This request must be accepted by Fun4Road before the event. Fun4Road may refuse replacement for reasons of safety, insurance, organisation, capacity, circuit access, formalities or consistency with the event category. Costs actually incurred to adapt the file may be charged.

9. Cancellation, postponement or modification by Fun4Road

Fun4Road may cancel, postpone, adapt the route, change the programme or replace certain elements where necessary, including in the event of insufficient participants, unavailability of a supplier or venue, decision by an authority, safety constraint, weather, accident, strike, breakdown, illness of an essential staff member, health measure, road issue, force majeure or other circumstances reasonably beyond Fun4Road’s control.

In the event of complete cancellation by Fun4Road before the event, the Client will receive, at Fun4Road’s choice depending on the circumstances, a refund of the price paid for the cancelled event, a credit note or a postponement proposal. Unless mandatory law provides otherwise, Fun4Road does not cover indirect or personal costs such as travel, hotel, fuel, holidays, registration, vehicle preparation, specific insurance or loss of enjoyment.

10. Obligations of the Client and Participant

Each Participant must comply with Fun4Road instructions, road traffic rules, local rules, speed limits, and instructions from authorities, circuits, private venues, suppliers and supervisors. Fun4Road events are leisure and navigation activities, not races, speed trials or timed competitions, unless expressly stated in writing.

The driver must hold a valid driving licence, be fit to drive and use a vehicle that is compliant, registered, insured, roadworthy and suitable for the activity. The Participant remains solely responsible for their driving, vehicle, passengers, personal belongings, route decisions and infringements.

11. Safety, exclusion and access to activities

Fun4Road may refuse or exclude, without refund, any Participant or vehicle presenting a risk or failing to comply with the rules: dangerous driving, alcohol, drugs, aggressive behaviour, failure to follow instructions, missing required documents, manifestly dangerous vehicle, excessive noise, failure to comply with a venue or circuit, or damage to Fun4Road’s image.

For activities on a circuit, private ground or controlled venue, the Participant must comply with the rules imposed by the operator. A waiver, indemnity, safety briefing or access document may be required. Refusal to sign or exclusion by the venue concerned does not entitle the Participant to compensation from Fun4Road.

12. Roadbook, GPX, geolocation and digital tools

Roadbooks, GPX tracks, tulips, notes, maps, waypoints and digital tools provided by Fun4Road are navigation and organisation aids. They never replace the driver’s attention, road signs, local rules, instructions from authorities or safety judgement.

Fun4Road does not guarantee the absence of error, road change, closed area, GPS loss, network failure, server unavailability, device incompatibility or reading error. The Participant must always adapt their driving to real conditions and stop safely in case of doubt.

13. Insurance

The Client and each Participant must check that their insurance covers the activity, the country crossed, the driver, passengers and, where applicable, use on a circuit or private ground. Fun4Road does not provide motor insurance, mechanical assistance, track cover, cancellation insurance or personal insurance, unless expressly stated in writing.

14. Liability of Fun4Road

To the extent permitted by law, Fun4Road is liable only for direct, certain and foreseeable damage resulting from a proven fault attributable to it. Fun4Road is not liable for damage caused by the Client, a Participant, a third party, an independent supplier, road condition, weather conditions, authority decision, technical failure, lack of network, navigation error, delay or force majeure.

Without prejudice to mandatory rights, Fun4Road is not liable for indirect damage, loss of enjoyment, business losses, loss of income, travel expenses, accommodation, fuel, vehicle preparation, damage to the vehicle, personal belongings, fines or consequences of an infringement. Nothing in these Terms limits liability that cannot legally be limited, including intentional fault, gross negligence where it cannot be excluded, or death or bodily injury caused by a proven fault of Fun4Road.

15. Force majeure

Force majeure or circumstances beyond Fun4Road’s control include, without limitation, severe weather, natural disaster, accident, fire, flood, strike, labour dispute, war, terrorist threat, pandemic, health measure, administrative decision, road or circuit closure, unavailability of an essential supplier, general failure, cyber incident, loss of internet access, or any event making performance impossible, unsafe or disproportionate.

16. Intellectual property

Fun4Road trademarks, logos, photographs, texts, roadbooks, GPX tracks, files, maps, notes, tulips, interfaces, databases, documents and content remain the property of Fun4Road or its partners. Unless authorised in writing, they may not be copied, resold, published, distributed, transmitted to a third party or used to organise a competing activity.

17. Personal data and cookies

Personal data processing, geolocation and cookies are described in the Privacy Policy and the Cookie Policy. These documents form part of the information provided to the Client and Participant.

18. Complaints

Any complaint must be sent to info@fun4road.be within a reasonable period and, where possible, within 15 days after the event. The Client must describe the facts, provide useful documents and allow Fun4Road to seek an amicable solution.

Consumers may, where the legal conditions are met, contact the Consumer Mediation Service.

19. Partial invalidity

If any clause is declared invalid, illegal or unenforceable, the other clauses remain applicable. The affected clause will, as far as permitted, be replaced by a valid clause that comes closest to the initial economic and legal objective.

20. Applicable law and jurisdiction

These Terms and Fun4Road contracts are governed by Belgian law. In the event of a dispute, the parties will first seek an amicable solution. Failing this, the competent courts of the district of Fun4Road’s registered office will have jurisdiction, subject to mandatory rules applicable to consumers.
